Please read the terms and conditions carefully before you DOWNLOAD the App. Installation of the App indicates that you accept and agree to be bound by the terms and condition in full. If you don't accept these terms and conditions do not download and use the App.
These Terms and Conditions are a legal Agreement that you must agree to use the Mobile App and are effective immediately for anyone accessing and using the Mobile App.
Definition of the Mobile App: Furniture Stores U Love is a Mobile Application that provides the list of the best rated and reviewed affordable furniture stores in the US and Canada to users for their best furniture shopping experience.
Definition of "You" and "Your": refers to you as a user of the Mobile App. A user is someone who downloads and accesses the Mobile App for personal use.
Definition of Furniture Stores: a furniture store is a retail business location serving customers by selling their products and/or services.
Definition of Furniture Retailers: a furniture retailer is someone who owns and/or is in charge of business establishment's operations including sales of products and/or services to customers.
Definition of the Owner of the Mobile App: the Owner of the Mobile App is someone who holds any intellectual or industrial property rights,and any other exclusive rights on this Mobile App or technical applications embedded in or related to this Mobile App.
The Owner of the Mobile App is also someone who manages and administers the functionality of the Mobile App.
THE OWNER OF MOBILE APP RESERVES THE RIGHT TO RELEASE UPDATES, FIXES AND FURTHER DEVELOPMENT OF THIS MOBILE APP AND/OR ITS RELATED SOFTWARE TO PROVIDE THEM TO USERS. USERS MAY NEED TO DOWNLOAD AND INSTALL SUCH UPDATES TO CONTINUE USING THIS MOBILE APP AND/OR ITS RELATED SOFTWARE. NEW RELEASES MAY ONLY BE AVAILABLE AGAINST PAYMENT OF A FEE.
ELIGIBILITY FOR USERS
Anyone can download and use the Mobile App without registering, creating an account, or providing any personal data and/or information such as name, address, phone number, birthday, ID numbers, physical appearance descriptions, geo locations etc. to the Owner of the Mobile App to download and use the Mobile App. The download fee is $1.99 USD and/or $2.99 CAD.
LICENSE TO USE
Subject to the terms of this Agreement, the Owner grants you nonexclusive, nontransferable, revocable license to use the Mobile App as permitted by this Agreement solely for your personal and noncommercial use. The Mobile App cannot be used for any other purpose. The Owner of the Mobile App reserves the right to modify, update, or discontinue these Terms and the Service at his sole discretion, at any time, for any or no reason, and without notice or liability. Your continued access to or use of the Mobile App after the effective date of changes to the Terms represents the acceptance of such changes.
SELECTION OF LISTINGS
Selection of furniture store listings is determined by the highest customer ratings and best customer reviews on major platforms such as Facebook, Google, Yelp as well as other platforms. Highest ratings may vary depending on the region, ratings and details of reviews about stores in a specific region. To qualify for a listing in the Mobile App a store must sell new furniture only, have an affordable price range marked at a single dollar sign($) and/or a double dollar sign($$)based on an average market cost of furniture, have a rating score of at least 4.0 or higher supported by at least 5 positive reviews on all major platforms and have no negative reviews on all major platforms. A store with no negative reviews and higher rating scores is considered the highest rated store. In some cases a store with a lower rating score and no negative reviews may be considered a higher rated store than a store with a higher rating score and 5 or more negative reviews. A review about a store is considered negative if it mentions customers' complaints about: insect/rodent infestation of merchandise and/or store; damage to merchandise caused by shipment or delivery and refusal to fix the damage; damage to household/property caused by shipment or delivery and refusal to fix the damage; discourtesy of staff after the purchase; giving customers false information about credit/financing services by not fully disclosing any hidden fees and/or interest rates of the financing services; false price advertising; selling customers refurbished merchandise without disclosing that at the time of purchase; delays in delivery of merchandise to customers without a prior notice of possible delays at the time of purchase; refusal to refund money paid towards a lay away; five or more recent(up to 1 year old)negative reviews; any negative reviews that are 50 words or more, any reviews describing customers' experience with a store as "worst", "terrible", "horrible", "awful", "disgusting" and any reviews describing any type of endangerment to customers' safety within a furniture retail location.
Single or double rating marks in a review section for customers' reviews without an actual negative review are not considered negative and do not disqualify stores from being listed in the Mobile App as long as a store's rating score is 4.0 or higher. Reviews about lack of attention to customers' inquiries or discourtesy of staff before the purchase, delayed opening hours, earlier than scheduled closing time, small retail space, no heat/air condition; unavailability of products in stock also do not disqualify stores from being listed in the Mobile App. Each listing is accompanied by rating scores from Google, Facebook and/or Yelp and is linked to either the website of a listed store or its profile on these platforms. The Owner determines the choice of either a platform or a website to link a listing to for the best shopping experience and convenience of locating a furniture store. A store listing can also be linked to any other platforms which show sufficient reviews and a location map. An already listed store cannot go lower than 4.0 rating score on any of the major platforms. The Owner of the Mobile App reserves the right to delete a listing without a prior notice should it go lower than 4.0 rating score on any of the major platforms. The Owner of the Mobile App reserves the right to delete a listing without a prior notice if newly added reviews describe any of the above mentioned issues which make a review negative according to these Terms and Conditions.
Since getting a listing in the Mobile App is free for furniture retailers the Owner of the Mobile App has no obligation to keep any listing in the Mobile App permanently. Each store listed in The Mobile App can be advertised on The Mobile App's public social media pages for an advertising fee. Requests for an advertising on The Mobile App's social media pages should be submitted via email: storesulove@gmail.com. The Mobile App does not cover every single city in the US and Canada. It only covers major statistical areas.
ELIGIBILITY FOR RETAILERS
Highest ratings may vary depending on the region and details of reviews about stores in a specific region. However, a furniture store has to have a rating score of at least 4.0 or higher on all major platforms supported by at least 5 positive reviews on all major platforms, have no negative reviews on all major platforms and be the highest rated and best reviewed of all the other furniture stores nearby to be considered for an add to the listings in the Mobile App. In some cases a store with a lower rating score and no negative reviews is considered a higher rated store than a store with a higher rating score and 5 or more negative reviews.
Any new furniture retailer can get a listing in the App free of any fees/charge if they meet selection criteria which include but are not limited to:
-a furniture store must sell new furniture only;
-a furniture store has to be physically located in the US and territories and/or Canada;
-a furniture store has to be listed on Google, Yelp and/or Facebook, have no negative reviews on all three major platforms and have the highest rating score in the region of physical retail location. The rating scores have to be supported by at least 5 positive reviews on all three major platforms and cannot be lower than 4.0 on all three major platforms;
-have inexpensive or moderate price range marked at a single dollar sign($) and/or a double dollar sign($$)based on an average market cost of new furniture;
-agree to allow 180 business days for consideration period to be added to the listings in the Mobile App which DOES NOT guarantee that a store will have a listing added to the Mobile App;
-customers' reviews MUST NOT have complaints about: insect/rodent infestation of merchandise and/or store; damage to merchandise caused by shipment or delivery and refusal to fix the damage; damage to household/property caused by shipment or delivery and refusal to fix the damage; discourtesy of staff after the purchase; giving customers false information about credit/financing services by not fully disclosing any hidden fees and/or interest rates of the financing services; false price advertising; selling customers refurbished merchandise without disclosing that at the time of purchase; delays in delivery of merchandise to customers without a prior notice of possible delays at the time of purchase; refusal to refund money paid towards a lay away; five or more recent(up to 1 year old)negative reviews; any negative reviews that are 50 words or more; any reviews describing customers' experience with a store as "worst", "terrible", "horrible" , "awful","disgusting" and any reviews describing any type of endangerment to customers' safety within a furniture retail location.
Furniture Stores that do not meet the selection criteria will not be considered for an add to the listings in the Mobile App, unless the rating scores and reviews change/improve within 180 business days to meet the selection criteria. The Mobile App cannot exceed its current size, so technical capabilities of expanding the number of listings may be limited. However, if a currently listed store is no longer open for business or went below the rating score of 4.0 on any of the three major platforms a new retail location may be added based on the selection criteria of these terms, with or without a prior notice.
MOBILE APP AVAILABILITY
The Mobile App may be modified, updated, interrupted, suspended or discontinued by the Owner at any time without notice or liability.
DISCLAIMER AND LIMITATION OF LIABILITY THIS MOBILE APP IS PROVIDED "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE". THE OWNER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
The Mobile App is only available for supported devices and might not work on every device. Determining whether Your device is a supported or compatible for use of the Mobile App is solely your responsibility, and downloading the Mobile App is done at a your own risk. The Owner does not represent or warrant that the Mobile App and Your device are compatible or that the Mobile App will work on Your device. In no event shall the Owner of this Mobile App be liable for any special, consequential, incidental or indirect damages whatsoever including, without limitation;(1) damages for loss of business profits; (2)business interruption, loss of business information; (3)any viruses or other disabling features that affect your access to or use of the Mobile App; (4) any changes to the algorithm by major platforms which some content of the app may be linked to; (5) any incompatibility between the Mobile App and hardware; or (6) any delays or failures you may experience in using the Mobile App, or any other pecuniary loss arising out of the use of or inability to use this product, even if the Owner of this product is aware of the possibility of such damages and known defects.
The Owner of the Mobile App makes no claims with respect to any third party such as the businesses listed in the Mobile App. Accordingly, the Mobile App is not liable to You for any personal injury, loss or damage that might arise from any such third party's actions or omissions, including for example if You or business misuses the content of the Mobile App, or if You have a negative experience with one of the businesses listed in the Mobile App. The limitations, exclusions and disclaimers in these terms apply to the maximum extent permitted by applicable law.
RESTRICTIONS ON USE
You are not permitted to (a)lease, rent, sub-license, publish, copy, modify, adapt, translate, reverse engineer, decompile, attempt to derive the source code of, or decrypt the Mobile App;(b)make any modification adaptation, improvement, enhancement or derivative work from the Mobile App; (c)violate any applicable laws, rules or regulations in connection with Your access or use of the Mobile App; (d) remove, alter or obscure any proprietary notice(including any notice of copyright or trademark) of the Owner of the Mobile App;(e)use the Mobile App for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended;(f)install, use or permit the Mobile App to exist on more than one Mobile Device at a time or on any other mobile device or computer;(g)distribute the Mobile App to multiple Mobile Devices; (h) make the Mobile App available over a network or other environment permitting access or use by multiple Mobile Devices or users at the same time;(i)use the Mobile App for creating a product, service or software that is directly or indirectly, competitive with or in any way a substitute for any services, product or software offered by the Owner;(j) use the Mobile App to send automated queries to any website or to send any unsolicited commercial email; or (k) use any proprietary information or interfaces of the Mobile App or other intellectual property of the Owner in the design, development, manufacture, licensing or distribution of any applications, accessories or devices for use with the Mobile App.
PRIVACY
The Mobile App does not collect, store and/or share with any third parties information such as name, address, phone number, birthday, ID numbers, physical appearance descriptions, geo locations about You/users who download the app as it has no servers or database to collect, store and/or share such information. You do not need to register, create an account or provide any of your personal information to download and use the app. Optionally, You may choose to provide Your email address or user name to communicate with the Owner via email. This information will be used only as You would expect and deleted upon request. This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, which may also collect and use data about you. The Owner is not responsible for any of the data collected by any such third party.
REFUNDS
The Mobile App does not provide any refunds on application purchases. Please do not contact the Owner with refund requests as the Owner cannot fulfill these requests. You can contact the support outlet for the platform in which you purchased the Mobile App, but the circumstances and eligibility for a refund is determined at their discretion. Each mobile platform has its own terms pertaining to refunds for purchase, these may vary by region. Generally you’re allotted a set time period in which refund requests can be submitted for a purchase. Once the provided time period has been exceeded a refund cannot be requested and will likely be declined.
TERMINATION
These Terms and Conditions are effective until terminated. You may terminate the Terms and Conditions by destroying the program and documentation and all copies thereof. These Terms are conditioned upon your continued compliance with this Agreement and will terminate automatically and irrevocably if you fail to comply with any term or condition of this Agreement.
